Employer Nomination Scheme (subclass 186)
OUR EXPERTISE
Subclass 186
Subclass 186 is a permanent employer-nominated visa. The streams are Temporary Residence Transition, Direct Entry, and Labour Agreement.
Exemptions from the age and English criteria exist for some occupations and some streams. We identify those from the current instrument, rather than list every exemption here.
Requirements
- An approved sponsor and a nomination in an eligible occupation.
- The age requirement for the stream, unless an exemption applies.
- Competent English, unless an exemption applies. The Department explains that English level.
- Employment in the nominated occupation with the sponsor.
- Health and character requirements.
The three streams
- Temporary Residence Transition: the worker has held an eligible temporary visa and has worked for the sponsor, in the occupation, for the period the stream requires.
- Direct Entry: a positive skills assessment, and at least three years of relevant skilled employment, unless an exemption applies.
- Labour Agreement: the worker and the employer meet the terms of the labour agreement.
What the nomination has to show
- The visa is permanent. It is granted only if the nomination is approved.
- The role has to be genuine, and the salary has to meet the market salary rate.
- We advise which stream is actually open, and which employment can be counted.
